OFFICIAL RULES
THE MY COUNTRY 99.3 WCON-FM TRUCK GIVEAWAY
NO PURCHASE NECESSARY TO ENTER OR WIN. VOID WHERE PROHIBITED.
1. Sponsor and Prize Provider
The My Country 99.3 WCON-FM Truck Giveaway (the “Truck Giveaway”) is sponsored by Habersham Broadcasting Company (the “Sponsor”), Licensee of 99.3 WCON-FM (the “Station”), located at P.O. Box 100, 540 N. Main Street, Cornelia, GA 30531. The Grand Prize vehicle is provided by Hayes Automotive of Baldwin (the “Prize Provider” or “Dealership”), located at 3656 State Highway 365, Baldwin, GA 30511. The Prize Provider’s sole role in the Truck Giveaway is to provide the Grand Prize and certain additional prizes. The Prize Provider is not a sponsor, co-sponsor, administrator, or operator of the Truck Giveaway.
2. Truck Giveaway Entry Period and Grand Prize Drawing Event Date
Eligible entrants may attempt to become a “Qualifier” for the Grand Prize Drawing, subject to verification and continued compliance with these Official Rules (the “Rules”), through one of three methods described in Section 7 of the Rules. The time period for entering the Truck Giveaway (the “Entry Period”) begins on March 21, 2026, at 11:00 a.m. (local time) at the “Hot Rods at Hayes” Event and ends at 7 p.m. on May 15, 2026. Entries received outside the Entry Period will not be eligible. The Sponsor’s computer is the official timekeeping system for the Truck Giveaway.
The Grand Prize Drawing Event will be held on May 16, 2026. QUALIFIERS MUST BE PRESENT AT THE DRAWING TO WIN THE GRAND PRIZE. (See Section 10.) For the purpose of these Official Rules, “Grand Prize Winner” or “Winner” refers to the individual who is chosen in the Grand Prize Drawing to receive the Grand Prize, subject to verification of eligibility and compliance with the Rules, regardless of whether the Vehicle Upgrade Option described in Section 4 is subsequently exercised.
3. Eligibility
The Truck Giveaway is open only to individuals who meet all of the following requirements: (1) are legal U.S. residents of Georgia, North Carolina, South Carolina, or Tennessee; (2) are at least twenty-one (21) years of age at the time of entry; and (3) possess a valid, government-issued U.S. driver’s license authorizing the lawful operation of a motor vehicle in their state of residence that is not expired, suspended, or revoked (a “valid U.S. driver’s license”). For purposes of these Official Rules, an eligible individual who submits an entry or attempts to qualify for the Truck Giveaway shall be referred to as an “Entrant.”
Employees, officers, directors, agents, and immediate family members of the Sponsor or Prize Provider are not eligible to participate. "Immediate family members" shall mean parents, step-parents, children, step-children, siblings, step-siblings, or spouses.
Any individual who has won prizes valued at Five Hundred Dollars ($500) or more from the Sponsor or Station in any contest or promotion within the ninety (90) days preceding the date of entry in the Truck Giveaway is not eligible to win any prize in the Truck Giveaway.
Entrants must meet all eligibility requirements at the time of entry and must continue to meet all eligibility requirements through the time of prize award and vehicle title transfer. Failure to meet or maintain any eligibility requirement will result in disqualification. No individual or household may obtain more than one (1) Qualifier status during the Entry Period. For purposes of these Official Rules, a “household” consists of individuals who share the same residence for at least three (3) months per year.
4. Grand Prize
One (1) Grand Prize will be awarded, consisting of a 2026 Chevrolet Silverado 1500, Crew Cab, four-wheel drive (the “Truck”) or Sponsor Substituted Vehicle, as described below (each referred to as the “Grand Prize”). The Manufacturer’s Suggested Retail Price (MSRP) of the Truck is $60,785. The Grand Prize may have mileage at the time of delivery due to transportation and use in promotional activities related to the Truck Giveaway prior to award.
Sponsor reserves the right, in its sole discretion, to substitute a vehicle of equal or greater MSRP (the “Sponsor Substituted Vehicle”), if for any reason, the advertised Truck becomes unavailable. The MSRP of the Sponsor Substituted Vehicle, shall be determined by the manufacturer’s official window sticker for that specific vehicle. No substitution, transfer, assignment, or cash redemption is permitted by the Winner, except for the Sponsor Substituted Vehicle or the Vehicle Upgrade Option below, provided in Sponsor’s sole discretion.
The Approximate Retail Value (ARV) of the Grand Prize is based solely on the MSRP of the vehicle and will be used for all prize disclosure and tax reporting purposes. No additional compensation, cash, credit, or adjustment will be provided based on retail pricing, promotional pricing, rebates, incentives, discounts, or other price variations.
Grand Prize features, options, accessories, color, interior, trim level, packages, and other specifications are determined by Sponsor and/or the Dealership in their sole discretion and may vary from images or descriptions used in advertising or promotion.
Mileage and Disclaimer of Warranties
The Grand Prize may have been displayed and/or driven for promotional purposes in connection with the Truck Giveaway prior to award and may have accumulated mileage. The Grand Prize Winner acknowledges and agrees that the Grand Prize is not being delivered directly from the manufacturer and may reflect reasonable mileage consistent with such promotional use. Acceptance of the prize constitutes the Winner’s agreement to accept the vehicle “as is,” with any mileage incurred prior to delivery due to transportation and promotional use.
Vehicle Upgrade Option
Sponsor may, in its sole discretion, permit the verified Grand Prize Winner to apply the MSRP of the Grand Prize toward the purchase of a different vehicle from the Dealership (the “Upgrade Vehicle”). The availability of this Vehicle Upgrade Option is solely within Sponsor’s discretion and may be conditioned, limited, or declined.
If the Vehicle Upgrade Option is permitted, and if the selected Upgrade Vehicle has an MSRP greater than the MSRP of the Grand Prize, the Winner must pay the full difference in price, including all applicable taxes, fees, dealer charges, and associated costs. The Winner will not receive any cash payment, credit, rebate, or refund if the selected Upgrade Vehicle has an MSRP less than the MSRP of the Grand Prize. Manufacturer incentives, rebates, discounts, promotional pricing, or dealer price adjustments shall not reduce the MSRP value applied toward the Upgrade Vehicle.
Any Upgrade Vehicle transaction constitutes a separate retail transaction solely between the Winner and the Dealership and is subject to Dealership approval, vehicle availability, and applicable terms and conditions. Sponsor is not a party to such transaction and is not responsible for financing, credit approval, pricing, availability, or any other aspect of the Upgrade Vehicle purchase.
Odds of Winning. The odds of winning the Grand Prize depend on the total number of eligible entries received during the Entry Period.
5. Other Prizes
$25 Visa® Gift Card
Each verified Qualifier will receive one (1) $25 Visa® Gift Card (the “Gift Card”), courtesy of Hayes Automotive of Baldwin. The ARV of each Gift Card is $25. A maximum of ninety-nine (99) Qualifiers will be selected during the Truck Giveaway. The maximum aggregate value of all Visa Gift Cards to be awarded is $2,475.00. Qualifiers who attend the Grand Prize Drawing Event will receive the Gift Card in person at the event. Qualifiers who do not attend the Grand Prize Drawing will receive the Gift Card via U.S. Mail at the home address provided to Sponsor. Gift Cards are subject to the terms and conditions of the issuer and are not redeemable for cash except as required by law. Visa® is a registered trademark of Visa Inc. Visa is not a sponsor of and is not affiliated with this Truck Giveaway. The odds of being selected as a Qualifier and receiving a Gift Card depend on the total number of eligible entries received during the Entry Period.
6. Taxes, Fees and Winner Expenses
The Grand Prize Winner is solely responsible for all federal, state, and local taxes and fees arising from acceptance, transfer, registration, ownership, and use of the Grand Prize or any Upgrade Vehicle, including but not limited to federal and state income taxes, sales taxes, use taxes, any applicable title ad valorem or personal property taxes, tag and registration fees, title fees, licensing fees, insurance, and any other governmental assessments, charges, or costs associated with the Grand Prize or Upgrade Vehicle.
Acceptance of the Grand Prize or any Upgrade Vehicle may result in substantial federal, state, and local tax liability.
A Form 1099-MISC will be filed with the Internal Revenue Service reflecting the total value of the taxable prizes awarded, and a copy will be furnished to the winner as required by law. The value reported to the Internal Revenue Service (and, if required, applicable state tax authorities) for the vehicle prize will reflect the Approximate Retail Value of the Grand Prize vehicle, whether or not the Winner elects the Vehicle Upgrade Option.
7. How to Enter
Only Entrants who qualify in accordance with these Official Rules will be deemed Qualifiers and may participate in the Grand Prize Drawing, subject to verification of eligibility and compliance with these Official Rules.
No purchase or payment is necessary to enter, qualify, or win. Sponsor does not impose any fee to participate. An Entrant may attempt to qualify by one of the following methods:
(a) “HOT RODS at HAYES” Event – March 21, 2026
Entrants may enter at the annual “Hot Rods at Hayes” Event on March 21, 2026, at Hayes Automotive of Baldwin, located at 3656 State Highway 365, Baldwin, GA 30511. The 2026 Chevrolet Silverado 1500 provided by Hayes Automotive will be on display at this event. There will be a ninety-nine (99) minute period beginning at 11:00 a.m. (local time) wherein Entrants can place Truck Giveaway entry forms in a barrel. Only one (1) entry per person is allowed. One (1) Qualifier will be selected by random drawing from the barrel at the conclusion of the ninety-nine (99) minute period. Drawings will be conducted by Sponsor or its designee. Entrants need not be present at the drawing time to be eligible for selection as a Qualifier. Qualification is provisional pending verification of eligibility and compliance with these Official Rules.
(b) On-Air Entry
Each weekday, Monday through Friday, at approximately 7:30 a.m. (local time) on WCON-FM 99.3, station staff will announce the two (2) two-hour listening windows scheduled for that day during which listeners should listen for the “My Country 99.3 Truck Giveaway” Cue. The two (2) listening windows will vary each weekday and will rotate among different time periods throughout the broadcast day between 7:30 a.m. and 7:00 p.m. The ninth caller to successfully reach the Station at (706) 778-0993 when the Cue is broadcast will become a Qualifier. Qualification is provisional pending verification of eligibility and compliance with these Official Rules. Standard telephone and wireless carrier charges may apply.
Due to technical limitations, the Station’s internet audio stream may be delayed from the Station’s over-the-air broadcast signal by several seconds or more. Listeners accessing the Station online may therefore be at a disadvantage in time-sensitive promotions, including cue-to-call promotions. For this Truck Giveaway, the Station’s over-the-air broadcast signal controls the timing of all Cues and call counts, as determined by the Station’s official timekeeping system. Sponsor reserves the right to modify, suspend, substitute, reschedule, or cancel any announced listening window or Cue-to-Call due to breaking news, emergency conditions, technical difficulties, equipment failure, or other circumstances beyond Sponsor’s reasonable control, and may reschedule such listening window or Cue-to-Call as Sponsor determines appropriate.
(c) Truck Stops
Entrants may enter the Truck Giveaway at WCON-FM’s “99-minute Live on Location” Truck Stop Events (the “Truck Stop Events”). The location, date, and time of the Truck Stop Events will be announced on-air and on the WCON-FM Website at https://www.mycountry993.com and on Social Media the day before each such Event, and notification will also be sent on the WCON-FM App. Sponsor may conduct up to eighteen (18) Truck Stop Events during the Truck Giveaway Entry Period; however, Sponsor reserves the right to modify, reschedule, or cancel any such event at its discretion if circumstances require. WCON-FM on-air personalities and/or staff will be present at various Truck Stop Events along with the 2026 Chevrolet Silverado 1500 provided by Hayes Automotive of Baldwin.
During each ninety-nine (99) minute Truck Stop Event, Entrants can place their entry form into a barrel. Limit one (1) entry per person per Truck Stop Event. One (1) Qualifier will be selected by random drawing from the barrel at the conclusion of each Event. Drawings will be conducted by Sponsor or its designee. Entrants need not be present at the drawing time to be eligible for selection as a Qualifier. Qualification is provisional pending verification of eligibility and compliance with these Official Rules. Sponsor may distribute promotional items of nominal value on a first come, first served basis while supplies last at some Truck Stop Events. Such items are not part of the Truck Giveaway prize pool.
Up to ninety-nine (99) total Qualifiers will be selected by all entry methods combined. The odds of becoming a Qualifier via the call-in method depend on the number of eligible callers attempting to reach the Station at the time the Cue is broadcast. The odds of becoming a Qualifier via the Hot Rod at Hayes Event and each Truck Stop Event depend on the number of eligible entries received at the applicable event. Sponsor reserves the right to disqualify any entrant who uses or attempts to use automated means, multiple identities, devices, or other methods to circumvent entry limits or interfere with the proper administration of the Truck Giveaway.
8. Qualifier Requirements
Upon initial qualification, Qualifiers must provide Sponsor with a valid telephone number, home address, and email address required for Truck Giveaway notifications and eligibility verification. Following initial qualification, Qualifiers will receive an email from the Sponsor transmitting a Qualifier Acknowledgment Form containing a link to these Official Rules.
Qualifier Acknowledgement
To remain eligible after receiving the Qualifier Acknowledgment Form, the Qualifier must complete and return the Form to Sponsor by email (the “Qualifier Acknowledgment”) by Sponsor’s specified deadline, acknowledging receipt of the Form, confirming eligibility to participate in the Truck Giveaway, and agreeing to comply with these Official Rules. The Qualifier’s typed name in the reply email will constitute their electronic signature. Failure to submit the Qualifier Acknowledgment by email by the deadline specified in the Sponsor’s transmittal email may result in disqualification, in Sponsor’s sole discretion.
Qualifiers are solely responsible for providing and maintaining a valid, working telephone number and email address for receipt of important Truck Giveaway notifications and related correspondence. Sponsor is not responsible for any notification or communication that is undeliverable, misdirected, filtered as spam, or not received due to inaccurate, incomplete, or inactive contact information, technical issues, or for any other reason beyond Sponsor’s control.
9. Use of Personal Information; Marketing Communications
By entering the Truck Giveaway, Entrant agrees that Sponsor Habersham Broadcasting Company and Station WCON-FM may use the personal information submitted in connection with this promotion, including name and email address, to contact Entrant by email regarding promotions, events, products, and services. Entrant further agrees that Sponsor may share Entrant’s personal information with the Prize Provider, Hayes Automotive of Baldwin, for marketing and promotional purposes, as permitted by applicable law. Personal information will not be sold.
Entrants may opt out of receiving promotional email communications at any time by following the unsubscribe instructions included in such communications.
All personal information collected in connection with the Truck Giveaway will be collected, used, disclosed, and maintained in accordance with these Official Rules and Sponsor’s Privacy Policy, available at https://www.mycountry993.com.
Entry does not constitute consent to receive marketing text messages, which must be separately provided, if offered.
10. Grand Prize Drawing Event
The Grand Prize Drawing Event will be conducted in person at Hayes Automotive of Baldwin, located at 3656 State Highway 365, Baldwin, GA 30511, on May 16, 2026, beginning at 10:00 a.m. (local time). Qualifiers must be present to win the Grand Prize. Mandatory Qualifier registration will take place between 10:00 a.m. and 11:00 a.m. Registration will close promptly at 11:00 a.m., and only Qualifiers who have registered or are in line to register no later than 11:00 a.m. will be permitted to participate. Qualifiers must present a valid U.S. driver’s license at check-in. Failure to do so may result in disqualification. Only Qualifiers who have complied with all qualification requirements set forth in these Official Rules and who remain eligible at the time of the drawing will be permitted to participate in the Grand Prize Drawing.
Upon completing registration, each Qualifier will be assigned a unique number and provided a ball labeled with that number to deposit into the Grand Prize Drawing barrel. The assigned number and corresponding ball are personal to the Qualifier, may not be transferred, assigned, sold, or given to any other person under any circumstances, and any attempted transfer will result in disqualification.
The Grand Prize Drawing will follow a reverse drawing format. The Grand Prize Drawing (or “Reverse Drawing”) will begin at 11:30 a.m. (local time) or after all Qualifiers who are in line to register no later than 11:00 a.m. have been registered.
Upon commencement of the Reverse Drawing, Sponsor or its designee will randomly remove balls from the barrel one (1) at a time. Each number drawn will be recorded and eliminated from the drawing. The last remaining ball in the barrel will determine the presumed Grand Prize Winner, subject to verification of eligibility and compliance with these Official Rules.
The person whose number corresponds to the last remaining ball must be physically present at the designated drawing location at the time the number is announced in order to be declared the presumed Grand Prize Winner. If the individual is not physically present when the number is announced, he or she will be disqualified. Sponsor will then select an alternate winner by proceeding in reverse order of elimination, beginning with the Qualifier whose ball was the last to be eliminated, and will continue in reverse order until an eligible and physically present Qualifier is confirmed as the presumed Winner or until no Qualifiers remain. For purposes of these Rules, “physically present” means personally present within the immediate drawing area, as determined by Sponsor, at the time the number is announced. Proxy attendance or virtual participation will not satisfy this requirement.
Sponsor’s decisions regarding the assignment of numbers, preparation and placement of balls, and conduct of the Reverse Drawing are final and binding. In the event of any discrepancy, damage, illegibility, duplication, or other irregularity relating to any ball or number, Sponsor may void the affected ball or number and proceed in a manner it deems fair and consistent with these Rules. Sponsor also reserves the right to correct any technical, mechanical, administrative, or human error and to take any action reasonably necessary to preserve the integrity of the Reverse Drawing, and Sponsor’s determinations shall be final and binding.
All Qualifiers present at the Grand Prize Drawing will receive a goody bag containing promotional items provided by Hayes Automotive of Baldwin and My Country 99.3 WCON-FM.
11. Winner Verification, Disqualification, and Delivery
Upon selection as the presumed Grand Prize Winner, the individual must provide: (1) proof of residency in Georgia, North Carolina, South Carolina, or Tennessee; and (2) a valid U.S. driver’s license demonstrating that the individual is at least twenty-one (21) years of age. The presumed Winner must have complied with all prior qualification requirements and must execute an Affidavit of Eligibility and Liability Release, complete and sign an IRS Form W-9 (as provided for tax reporting purposes), and provide any other documentation reasonably required by Sponsor to verify identity, eligibility, and legal authority to accept, own, register, and insure the Grand Prize and, if applicable, any Upgrade Vehicle.
Except where prohibited by law, the Winner will also be required to execute a written Publicity Release. In jurisdictions where conditioning prize receipt on execution of a publicity release is prohibited by applicable law, execution of the Publicity Release shall be voluntary and not a condition of receiving the prize.
Within seventy-two (72) hours following selection as the presumed Grand Prize Winner (unless extended by Sponsor in its sole discretion), the individual must complete all documentation necessary for titling and registration of the vehicle in his or her name and must provide proof of valid automobile insurance issued in the individual’s name, specifically covering the vehicle identified by VIN, and meeting or exceeding the minimum liability coverage requirements of the state in which the vehicle will be titled and registered. Prior to title transfer, registration, tag issuance, or release of the vehicle, all such documentation must be completed and verified.
If the presumed Grand Prize Winner fails to timely complete any required documentation, is unable to obtain required automobile insurance within the specified time period, is deemed uninsurable by a licensed insurance carrier based on documentation provided, or otherwise fails to satisfy any eligibility or legal ownership requirement, the presumed Winner may be disqualified at the Sponsor’s sole discretion and the prize forfeited.
In the event of disqualification or forfeiture after the Grand Prize Drawing has concluded, Sponsor will select any alternate presumed Grand Prize Winner strictly in accordance with the official recorded order of elimination from the Reverse Drawing described in Section 10. Sponsor will first contact the Qualifier whose ball was drawn next-to-last, as reflected in the recorded results. If that Qualifier is ineligible, noncompliant, cannot be contacted, fails to timely respond, or forfeits the prize, Sponsor will continue contacting Qualifiers in reverse order of elimination, based on the recorded drawing results, until an eligible and compliant Qualifier is confirmed as the Grand Prize Winner or until no Qualifiers remain.
Delivery
The Grand Prize must be accepted as awarded and will be available for pickup at a location designated by Sponsor or Dealership within a commercially reasonable time following verification of eligibility and completion of all required documentation, subject to vehicle availability, title processing requirements, and other administrative considerations. Winner must present valid government-issued photo identification and proof of insurance prior to taking delivery.
If Sponsor permits the Winner to use the Upgrade Vehicle Option described in Section 4, and the Winner elects to do so, delivery of any Upgrade Vehicle shall be governed solely by the terms of the separate retail transaction between the Winner and the Dealership. Sponsor is not responsible for the timing, condition, financing, availability, transfer, or delivery of any Upgrade Vehicle.
12. Publicity; Record Retention
Except where prohibited by applicable law, participation in the Truck Giveaway constitutes each Entrant’s consent to Sponsor and its designees to use the Entrant’s name, voice, likeness, photograph, statements made in connection with the Truck Giveaway, biographical information, and city and state of residence in connection with the advertising, promotion, and publicity of the Truck Giveaway and related promotional activities, in any media now known or hereafter developed, without further notice, approval, or compensation.
Where permitted by applicable law, as a condition of receiving the Grand Prize or Upgrade Vehicle, the Grand Prize Winner may be required to execute a Publicity Release granting Sponsor and its designees the right to use the Winner’s name, likeness, photograph, voice, statements made in connection with the Truck Giveaway, biographical information, and city and state of residence in connection with the advertising, promotion, and publicity of the Truck Giveaway and related promotional activities, in any media now known or hereafter developed, without additional notice, approval, or compensation. Failure or refusal to execute the required Publicity Release in jurisdictions where conditioning prize receipt on such execution is permitted may result in disqualification and selection of an alternate Winner in accordance with these Official Rules. In jurisdictions where conditioning prize receipt on execution of a publicity release is prohibited by law, refusal to execute such release shall not invalidate the prize award.
Entrants understand that telephone calls may be recorded and monitored and that in-person participation may be photographed, filmed, or otherwise recorded, and agree that such recordings may be used for promotional purposes consistent with these Official Rules.
Sponsor may retain Qualifier Acknowledgment emails submitted by Qualifiers, audio recordings of telephone calls made or received in connection with the Truck Giveaway (including call-in entries and Winner notifications), and the executed Affidavit of Eligibility and Liability Release and any Publicity Release submitted by the Grand Prize Winner for a commercially reasonable period for purposes of administration, eligibility verification, legal compliance, promotional review, and dispute resolution. Retention of personal information for marketing communications, if applicable, is governed by Section 9 of these Official Rules and Sponsor’s Privacy Policy.
13. No Purchase or Payment Necessary
No purchase is necessary to participate in the Truck Giveaway or to win. Participation does not require a Dealership sales presentation or test drive. The Dealership is participating solely as the Prize Provider and event location and is not a sponsor, co-sponsor, administrator, or operator of the Truck Giveaway.
14. Official Rules
These Rules will be available online at the Station website: https://www.mycountry993.com beginning on March 21, 2026, at 10:00 a.m. and continuing for thirty (30) days after the Grand Prize Drawing on May 16, 2026. Sponsor reserves the right to clarify non-material, administrative details of the Rules.
15. Winner List
For a period of thirty (30) days following the Grand Prize Drawing, the name and city of residence of the verified Grand Prize Winner will be available upon written request to Sponsor at the following address: Habersham Broadcasting Company, P.O. Box 100, 540 N. Main Street, Cornelia, GA 30531.
16. Sponsor Authority
Sponsor shall have sole discretion to interpret, administer, and enforce these Official Rules and to make all determinations relating to the Truck Giveaway, including but not limited to eligibility, timeliness, entry validity, identification, disqualification, participation, Winner selection, prize substitution, and resolution of any dispute or circumstance not expressly addressed herein.
Sponsor reserves the right to cancel, terminate, suspend, or modify the Truck Giveaway in the event that circumstances beyond Sponsor’s reasonable control, including but not limited to technical or mechanical failures, fraud, tampering, or administrative error, compromise or threaten to compromise the integrity, fairness, or proper administration of the Truck Giveaway. In such event, Sponsor may take such action as it reasonably determines appropriate to preserve the integrity of the Truck Giveaway. Any material change will be announced on-air and disclosed on the Station’s website in accordance with applicable rules.
All determinations of Sponsor shall be final, conclusive, and binding, except as otherwise required by applicable law. By participating, each entrant agrees to be bound by Sponsor’s determinations.
17. Liability Release, Assumption of Risk, and Limitations
Participation in the Truck Giveaway is voluntary and limited to eligible Entrants. Any Entrant selected and verified as the Grand Prize Winner remains an Entrant for all purposes of these Official Rules.
By entering the Truck Giveaway, each Entrant, on Entrant’s own behalf and on behalf of Entrant’s heirs, executors, administrators, personal representatives, successors, and assigns, knowingly and voluntarily waives, releases, and forever discharges the Sponsor, Station, and Dealership, including without limitation their respective parent companies, subsidiaries, affiliates, members, managers, officers, directors, shareholders, employees, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from any and all rights, claims, demands, causes of action, liabilities, damages, losses, costs, and expenses of any kind whatsoever, whether known or unknown, suspected or unsuspected, arising out of or relating to participation in the Truck Giveaway, registration or submission of an entry, the administration or operation of the Truck Giveaway, or Winner selection.
Claims released by Entrants (including the Grand Prize Winner), include, but are not limited to, claims for negligence, personal injury, death, property damage, economic loss, invasion of privacy (including appropriation, intrusion, public disclosure of private facts, or false light), defamation, violation of right of publicity, or any other legal or equitable theory arising from participation in the Truck Giveaway or acceptance or use of the Grand Prize, to the fullest extent permitted by applicable law.
If an Entrant is selected and verified as the Winner, then by accepting the Grand Prize, the Winner, on the Winner’s own behalf and on behalf of Winner’s heirs, executors, administrators, personal representatives, successors, and assigns, knowingly and voluntarily waives, releases, and forever discharges the Released Parties from any and all claims arising from or relating to the acceptance, receipt, possession, condition, ownership, use, or misuse of the Grand Prize.
Each Entrant assumes all risks associated with participation in the Truck Giveaway. Upon transfer of title and possession of the Grand Prize or any Upgrade Vehicle, the Winner assumes all risks associated with ownership and operation of such vehicle and acknowledges that operating a motor vehicle involves inherent risks of injury, death, and property damage.
The Winner acknowledges that the Grand Prize is awarded “AS IS” and “WHERE IS,” with all faults, without warranties of any kind by Sponsor, Station, or Prize Provider, express or implied, except solely for any manufacturer’s standard limited warranty, if any. Sponsor, Station, and Prize Provider make no warranties or representations regarding condition, safety, merchantability, fitness for a particular purpose, or suitability of the Grand Prize.
The Winner further acknowledges that any Upgrade Vehicle transaction constitutes a separate retail transaction solely between the Winner and the Dealership, subject exclusively to the terms and conditions of that transaction, and that Sponsor and Station are not parties to such transaction and shall have no responsibility or liability for, and are released from any and all claims arising from or relating to, the condition, ownership, use, operation, financing, pricing, availability, approval, delivery, documentation, or performance of any Upgrade Vehicle. The Winner further agrees that the Dealership, in its capacity as Prize Provider, is released from any claims arising out of or relating to the Truck Giveaway, excluding claims arising solely from the separate retail purchase transaction for an Upgrade Vehicle under applicable law.
Effective upon transfer of title and possession of the Grand Prize or any Upgrade Vehicle, the Winner shall indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from or relating to the Winner’s ownership, possession, maintenance, or operation of the Grand Prize and any Upgrade Vehicle.
The Released Parties are not responsible for incorrect or inaccurate information; technical malfunctions of any kind; computer, network, website, platform, server, telephone, or cellular failures; busy signals; dropped, misdirected, disconnected, incomplete, or delayed calls; audio, recording, broadcast, or transmission errors; failures in entry collection or processing; or any other technical or human error that may prevent a call or entry from being received, answered, recorded, verified, or properly processed. The Station’s official timekeeping systems and records shall control in the event of any dispute regarding call-in participation, entry timing, or winner determination. The Released Parties are further not responsible for lost, late, illegible, damaged, destroyed, stolen, misdirected, or improperly completed entries or required documentation, whether submitted by telephone, online, or in person; errors in the collection, handling, storage, tabulation, or drawing of entries; or any injury, loss, or damage arising from attendance at, participation in, or travel to or from any promotional event or drawing.
The Released Parties shall not be liable for any failure to conduct the Truck Giveaway as planned due to causes beyond Sponsor’s reasonable control, including but not limited to acts of God, weather events, equipment failure, labor disputes, governmental action, or other force majeure events. To the fullest extent permitted by law, the Released Parties shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the Truck Giveaway, any entry, or the Grand Prize or Vehicle Upgrade. Except where prohibited by law, an Entrant’s sole and exclusive remedy is limited to actual out-of-pocket expenses incurred solely for participation in the Truck Giveaway, and in no event shall the total liability of the Released Parties exceed the MSRP of the Grand Prize as determined pursuant to Section 4.
18. Disputes; Governing Law; Venue; Damages
As a condition of participating in the Truck Giveaway, each entrant agrees that any dispute, claim, or cause of action arising out of or relating in any way to the Truck Giveaway, these Official Rules, or any prize awarded shall be resolved individually, without resort to any form of class action, collective action, consolidated action, or representative proceeding. Entrants expressly waive any right to participate in a class action or to seek relief on a class or representative basis.
All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, or the rights and obligations of Entrants and Sponsor in connection with the Truck Giveaway, shall be governed by and construed exclusively in accordance with the laws of the State of Georgia, without giving effect to any choice-of-law or conflict-of-law rules that would cause the application of the laws of any other jurisdiction.
Any legal action or proceeding arising out of or relating to the Truck Giveaway shall be brought exclusively in the Superior Court of Habersham County, Georgia, or, if federal jurisdiction exists, in the United States District Court for the Northern District of Georgia, Gainesville Division. Each entrant irrevocably submits to the personal jurisdiction and exclusive venue of such courts and waives any objection based on improper venue, lack of personal jurisdiction, or forum non conveniens.
To the fullest extent permitted by applicable law, Entrants waive any right to claim punitive, incidental, consequential, special, or exemplary damages, including attorneys’ fees, arising out of or relating to the Truck Giveaway. Entrants further waive any right to have damages multiplied or otherwise increased.
Each Entrant knowingly and voluntarily waives any right to trial by jury in any action or proceeding arising out of or relating to the Truck Giveaway.
19. Severability and Survival
If any provision of these Official Rules is determined to be invalid, illegal, or unenforceable under applicable law, such provision shall be severed and the remaining provisions shall remain in full force and effect. To the fullest extent permitted by law, any invalid or unenforceable provision shall be construed and modified to the minimum extent necessary to make it valid and enforceable while preserving Sponsor’s original intent.
The liability limitations, releases, indemnification obligations, damage waivers, Sponsor authority provisions, and dispute resolution provisions contained in these Official Rules shall survive the conclusion of the Truck Giveaway and the award and transfer of any prize awarded in connection with the Truck Giveaway, and shall remain in effect indefinitely to the fullest extent permitted by law.
The My Country 99.3 WCON Truck Giveaway shall be conducted in accordance with all applicable federal, state, and local laws and regulations, and these Official Rules are subject to any requirements or limitations imposed by such laws.
